Representative Cases
Cases involving fires, toxics, electrical incidents, and chemical exposures all involve scientific knowledge, and often require understanding of specialized industrial or agency practices. Agencies ranging from Public Utility Commissions to Fire Departments, and from OSHA to the EPA, may be involved. In addition, these cases often require understanding of specialized medical areas. Burn injuries, for example, often involve highly sophisticated treatment at burn centers; electrical injuries may involve both burns and neurological impairments; and different chemical exposures have different consequences, ranging from burns to birth defects. Investigation and prosecution of cases in these areas requires skills and resources beyond ordinary personal injury cases. The attorneys of the Corson & Johnson Law Firm have been involved in the successful prosecution of many fire, toxic, electrical, and chemical injuries, with years of insider experience representing an electric utility. We have worked with fire investigators, toxicologists, electric utility linemen, burn injury physicians, and scientists and engineers in numerous disciplines from fuel system design to electric engineering. Power Line Contact: Electric Burn Injuries This case involved a Central Oregon worker who received severe, permanent electrical burn injuries to his head and elsewhere as a result of an inadvertent contact with a power line that was dangerously close to the building that they were preparing to paint. The man's coworker was operating an aerial lift bucket next to the building; the power lines were so close to the building that they were in violation of the applicable provisions of the National Electric Safety Code (NESC). The case settled successfully after discovery of the power company's pertinent internal records. Chemical exposure: blindness in one eye Don Corson was the lead liability lawyer on a case involving a Lane County, Oregon man who worked at a wood products factory and who suffered loss of sight in one eye. A chemical delivery system malfunctioned, resulting in a toxic chemical spraying the worker's face. Development of the case included taking testimony from key personnel of the supplying chemical company back east. The case settled after depositions. Swimming Pool Chemical Explosion This case involved a Southern Oregon woman who bought pool maintenance chemicals from a pool supply retailer. The store provided the wrong chemicals to the woman as a result of poor product labeling that made it easy for the store personnel to confuse the different chemical products. When the woman mixed the products in the normal fashion, the dangerous combination of chemicals exploded. The woman's lungs were injured, resulting in permanent Adult Respiratory Distress Syndrome (ARDS). Wood Products Mill Explosion: Death This case involved a Central Oregon man who worked at a mill in Deschutes County. The man was working on a green dryer that malfunctioned, resulting in an explosion which caused his death. Prosecution of the case included working with industrial and computer engineers to discover the cause of the control system defect that allowed the pressure to build to explosive levels. The case settled after the key engineer for the defendant company admitted in his deposition that the system was not designed in accordance with correct engineering principles. House Fire: Death of Two Children Don Corson represented the family of two young children who were killed in a fire at a rental home on the Oregon coast. The house had inadequate fire protection systems, and highly flammable interior wall coverings. Other Cases The attorneys of the Corson & Johnson Law Firm have been involved in a wide variety of other fire, toxic, electric, and chemical injury cases, including power line contacts, power line failures, recreational vehicle fires, pharmaceutical injuries and deaths, and others.
