While not all accidents are preventable, often times they are the result of another person or group's wrongful or negligent behavior. Industrial, construction, and workplace accidents are sometimes the result of inadequate safety measures, training, or risk management.

Investigating construction and industrial accidents

Initial investigations are typically conducted by others, often while the injured worker is still in the hospital. Here in Oregon, an industrial or construction accident will normally be investigated by the state's Occupational, Safety, and Health Administration (OSHA), and by the workers compensation insurance carrier for the employer (e.g., SAIF, Liberty). There may also be investigations by law enforcement agencies, and by persons or insurance companies working on behalf of potential defendants who were responsible in whole or part for the loss.

An injured worker usually has rights and benefits under the workers compensation system, and it is frequently advisable to retain another attorney who specializes in the workers compensation field. Under Oregon law, most often the direct employer and co-workers are immune from liability for their negligence. However, if a another (third) party's fault was a substantial factor in causing the loss, that third party may be liable to the injured worker or that person's family. "Third parties" may include: the manufacturer or supplier of defectively manufactured or negligently maintained equipment; other companies that had some control or supervision over the work; architects or engineers, if they were negligent in their analyses, plans, or instructions; and possibly others.

Freak accident ties up Morristown traffic
