Careless Driving Leads to Head-On Collision and Roll Over
$1.095 Million Settlements for Injuries
Ed and Sheryl were on vacation, driving their recreational vehicle (RV) on a two-lane road in rural Northern California, when a storm hit. A commercial pickup truck was going the opposite direction about 60 mph despite the heavy rain that turned to hail. Approaching a sweeping curve in the road, the truck driver lost control, started sliding, crossed the center line, and crashed into head-on into Ed and Sheryl. This head-on collision caused their recreational vehicle to be forced off the road, and over a steep boulder-strewn embankment. Their vehicle rolled over several times before it crashed into a tree. The police report described the result of this careless driving and head-on collision as “complete and total roll over damage.”
Eyewitness and Law Enforcement Confirm Careless Driving
An eyewitness who was traveling directly behind Ed and Sheryl’s vehicle confirmed that the truck driver lost control and caused the collision. The investigating law enforcement officer concluded that the truck driver was the sole cause of this head-on collision and subsequent roll over.
Crash Led to Multiple Injuries
When the paramedics arrived, Sheryl and Ed were being extricated from their demolished vehicle by other emergency personnel. The couple was taken to the hospital with multiple injuries. The collision and roll over resulted in a fractured neck for Ed. Sheryl had numerous broken bones. Over the next few months, some of her injuries required surgery and other medical procedures. She also had facial scarring. After their hospital stays, both Ed and Sheryl required stays in skilled nursing facilities. Sheryl had a prolonged course of recovery, spending time in a wheelchair and then on crutches. Both were eventually able to return to work, but at reduced levels.
The business attorney for Ed’s employer referred the couple to us, and their personal injury claims were eventually settled for a total of $1.095 million.
