Going Beyond Workers Compensation

JOEL:This is Joel Block for The Law and You with Eugene attorney Don Corson. Don, you recently had a case involving a worker who was injured at a construction site and workers comp didn’t cover all the losses. What happened?

DON: Joel, Workers Compensation is limited in what it can do for injured workers. Our client was hit by a car that came speeding into a highway construction zone and struck him, causing serious and permanent injuries that required surgery. Workers comp paid for only part of the losses. Our investigation found that the general contractor had not followed standard safety measures to protect subcontractors and other workers on the job site. At the trial, the jury found that both the driver and the contractor were negligent. The verdict allowed workers comp to be reimbursed, and for the injured worker to receive help with losses that workers comp did not cover.
