Case Brings Injured Worker Justice
This segment of The Law and You features personal injury trial lawyer Don Corson telling of a “third party case” he filed for an injured worker to hold a manufacturer responsible for the defective machinery that was responsible for the worker’s injury.

JOEL: This is Joel Block for The Law and You with Eugene attorney Don Corson. Don, when someone is hurt while on the job, is workers’ compensation insurance the only legal help available?
DON: Not necessarily. For example, I represented a man who was permanently injured by a machine while working at a maintenance shop. It went beyond a workers’ comp case when our investigation pinpointed design defects in the machine. We were able to bring a case against its manufacturer. We are often able to help a worker though the court system if the injury is caused by a defective product or by someone from another company and under a few other circumstances. These are called third party cases. They make the party who was actually responsible for the injury pay the costs of the harm they caused. The goal is to improve safety. And third party claims also cover emotional trauma and other losses that workers compensation does not.
