Don’t Wait if You’re in a Collision With an Underinsured Motorist

JOEL: This is Joel Block for The Law and You with Eugene attorney Lara Johnson. Lara, one of the questions we received concerned a car accident in which there was not enough insurance to cover the losses.
LARA: Joel, Oregon law requires that drivers have auto insurance; however, the law does not make sure that there is adequate insurance. When a driver who causes an accident does not have enough insurance to fully pay for the losses, the injured person is left with unpaid medical bills and lost income. Your own automobile insurance company may be able to fill in this gap under your underinsured motorist coverage. If you’ve been injured by an underinsured motorist, don’t wait. Evidence may be lost, witnesses’ memories fade, or time may run out to even file a claim. An attorney can help you determine how to protect your rights under that insurance coverage.
