A retired Forest Service employee was riding his bicycle for exercise next to a rural road. An underinsured driver swerved onto the shoulder of the road and struck the bicyclist at more than 50 miles per hour. The bicyclist suffered serious leg fractures and shoulder injuries that required surgeries. After a settlement with the underinsured driver, the bicyclist’s own insurance company refused to pay the bicyclist the underinsured motorist insurance benefits he had paid for. We filed the case in federal court against the insurance company, with claims for breach of contract, negligence, and financial abuse of a vulnerable person over the age of 65. The case settled for the full amount to which the bicyclist was entitled.
